Will Texas’s new abortion law create a loophole that can fit a truck through from the federal government?

The Nation’s editor-at-large, Elie Mystal, discusses with host Molly Jong-Sat during this episode of The New Abnormal about the possibility of the Biden administration sending abortion units to get around the new rules of the Lone Star State. 

“If Joe Biden via executive order established, let’s call it a federal privacy commission, and hired a bunch of doctors and empowered them to drive throughout the country in a truck or a van enforcing privacy rights, guess what? They’d be federal officials performing their duties and thus, through qualified immunity, immune from private civil actions,” Elie says.

However, the Hyde Amendment can impede this, because it prohibits the use of federal funds to pay for abortions unless it will save a woman’s life.

Elie adds, that the abortion rights protection should come from the court-packing since the Supreme Court and the 5th Circuit judges who enabled this law to go forward are mad “crazy” as he says.

Molly mentioned that this move by Texas is obviously unconstitutional, but she is also afraid that this is just the start. 

U.S veteran and Congressman Ruben Gallego followed Elie’s turn and spoke about Afghanistan and his thoughts on President Biden’s right decision to pull out. 

According to Gallego:

“Had we found another justification for being there we would’ve stayed there longer. The Taliban would have started attacking and then we would have had to stay longer because you can’t leave while they’re attacking you,” 

Molly also tried to convince Gallego to divulge if he’d primary Sen. Kyrsten Sinema.
